The State has systematically failed to align its statutory duty with its legislative duty—particularly in the context of a protocol subsequently followed per a material decision of Seanad Éireann. That decision is a matter of public record and demonstrates the prior knowledge and awareness of legislative members at the time.

The presentation demonstrates that this matter lies not only outside SIPO's remit, but also outside the operational scope of every parliamentary committee and government department—making it an exemplary case of what the Meinhardt corpus terms Remit Displacement: a public risk that has no institutional address.

The problem does not reside in the disciplines themselves—Operations Research, Decision Science, and Formal Organisation Theory are directly relevant to State functioning, national planning, institutional accountability, and public decision-making systems. The failure lies in the refusal to recognise and deploy them at government level.

When information is presented clearly, and still no structure is ready to accept responsibility—that is a remit failure.
On the Nature of the State as System

Public power is not a linear mechanism where knowledge = action. It is a more complex, interactive, sometimes self-defensive system. The institutional corpus can receive information without responding, transform it, defer it, or use it in ways that do not benefit the public.

Each document had an immediate diplomatic purpose when created, but now each carries lasting scholarly and legal value. The Secretary-as-Archivist bears the living link between the immediate purpose of the office and the historical foundation that sustains continuity.

In the context of this submission, made for purposes of public registration and in the interest of press transparency, the claim is made that privacy, personal rights, and intellectual rights remain under legal and ethical protection—including research currently missing, the consular advisory index, and international provisions regarding safe harbour obligations.

In the future, when scrutinising where the State stands regarding accountability and welcome of critical information, this material will be a clear indicator of what was noticed, understood.
